GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

1. Scope

1.1. These General Terms and Conditions of Sale (hereinafter the "GTCS") govern all sales made on the website www.semerdjianchaussures.fr (hereinafter the "Site") for the brand SMR23 by Semerdjian. The Site is published by the company SILVER ONE (hereinafter "the Seller"). 1.2. The GTCS apply solely to consumers as defined by the Consumer Code. 1.3. Any order placed on the Site implies full and unreserved acceptance of these GTCS.

2. Seller

2.1. 3. Modifications to the GTCS

3.1. Semerdjian may modify these GTCS at any time. 3.2. The applicable GTCS are those in force on the date of the order. 3.3. The Customer is invited to consult the GTCS for each new order.

4. Customer Account and Guest Order

4.1. The Customer may order by creating an account or as a guest. 4.2. The Customer agrees to provide accurate and up-to-date information. 4.3. Account usage terms are specified in the TOU (Terms of Use).

5. Products

5.1. Semerdjian describes and presents its products. 5.2. Photographs are non-contractual. 5.3. Products are offered within the limits of available stock.

6. Price

6.1. Prices are displayed in Euros, all taxes included (VAT included). 6.2. Delivery costs are indicated at the time of order. 6.3. Semerdjian may modify prices at any time. 6.4. In the event of a manifest price error, the order may be cancelled. 6.5. The price applied is the one displayed at the time of validation.

7. Order

7.1. The Customer selects the desired products and validates their cart. 7.2. Before payment, a summary allows the Customer to verify and correct information. 7.3. The order is validated after acceptance of the GTCS, payment, and confirmation by email. 7.4. Semerdjian reserves the right to refuse an order in the event of a dispute or suspicion of fraud.

8. Availability

8.1. Products are offered within the limits of stock. 8.2. In case of unavailability after payment, the Customer will be informed and refunded without delay. 8.3. A restocking delay may be proposed if applicable.

9. Payment

9.1. Payments are made via Shopify Payments (Credit Card, Apple Pay, Google Pay...). 9.2. Banking data never passes through the Site. 9.3. The order is confirmed only after validation of the payment.

10. Delivery

10.1. Areas served: Products are delivered to the delivery address indicated during the order process, in the following countries: – Metropolitan France – Germany – Austria – Belgium – Spain – Estonia – Ireland – Italy – Latvia – Lithuania – Luxembourg – Netherlands – Portugal – Slovakia – Slovenia

10.2. Estimated times: – France: 2 to 5 business days – Europe (Euro zone): 4 to 8 business days

10.3. Carriers: Orders are shipped via our logistics partners (e.g., GDC, Colissimo, Chronopost...), depending on the choice available at the time of order. 10.4. Mondial Relay: Pick-up via Mondial Relay may be available depending on options displayed at the time of order. 10.5. Updated information: Delivery methods, costs, times, and carriers are updated automatically in the checkout tunnel. 10.6. Customer Liability: The Customer must verify the accuracy of their address. 10.7. Unclaimed package / Incorrect address: In the event of a return to sender due to an incorrect address or non-claim, only the price of the products will be refunded (excluding shipping costs).

11. Retention of Title

11.1. The products remain the full property of the Seller until full payment of the price. 11.2. Risks are transferred to the Customer upon handover of the package.

12. Right of Withdrawal and Returns

12.1. The Customer has a legal period of 14 days to exercise their right of withdrawal from receipt. 12.2. Return and Fitting Conditions: To validate the return, the Customer must respect the following instructions: – Fitting: Shoes must be tried on indoors only, on a clean and smooth surface (rug, carpet) so as not to mark the soles. – Condition: Products must be returned new, unworn outdoors, undamaged, and unsoiled. – Packaging: Shoes must be returned in their intact original box, accompanied by all tags. Attention: The shoe box must not be used as the shipping carton; it must be placed in a suitable transport carton. 12.3. Return Costs: Return shipping costs are exclusively the responsibility of the Customer. 12.4. Refund: The refund (product price + standard outbound delivery costs) is issued within 14 days after receipt and verification of the return's compliance. 12.5. Refusal of return: Semerdjian reserves the right to refuse the refund if the soles are marked, if the leather is creased due to prolonged use, or if the original box is taped or damaged.

13. Legal Guarantees

13.1. Legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code). 13.2. Guarantee against hidden defects (Articles 1641 et seq. of the Civil Code). 13.3. Any claim must be detailed and accompanied by photos.

14. Liability

14.1. Semerdjian is not liable for indirect damages. 14.2. Nor for damages caused by non-compliant use. 14.3. Nor in case of force majeure.

15.1. Personal data is processed in accordance with the GDPR. 15.2. Details can be found in the Privacy Policy.

17. Mediation – CM2C

18. Applicable Law and Competent Jurisdiction

18.1. These GTCS are governed by French law.

18.2. The Customer may bring the matter before the courts of their place of residence. 18.3. Mediation must be requested before any legal proceedings.
